1. The Contest
The FrogPlay Championships Contest ("Contest") is an online contest organised through joint collaboration between FrogAsia Sdn Bhd (Company No. 968641-K) ("FrogAsia") and Frog Education Ltd (“Frog”) (Company No. 03935677) and shall be participated by Participants from Malaysia, Australia, Hong Kong, United Kingdom, Denmark, France, Switzerland, Italy, Luxembourg, Netherlands, Spain, the United States, Saudi Arabia and South Africa (collectively referred to as the “Participating Countries”) on their respective e-learning platforms and in accordance to the respective countries time zone. Participants in each of the respective countries shall be subjected to the contest terms and conditions stated on their respective e-learning platforms. Eligible students and schools may participate in the Contest through the FrogPlay Platform and shall be governed by these FrogPlay Championships Contest Terms and Conditions (hereinafter referred to as the “Contest Terms”).
2.1 The Contest is organised on the FrogPlay platform, either accessed within the Frog Virtual Learning Environment (‘FrogLearn’) or accessed directly as a ‘standalone’ customer of the “FrogPlay Platform”
2.2 This Contest is open to all schools who subscribe to or are provided the FrogPlay Platform. Participating Schools and Participating Students shall be collectively referred to as “Participants”. Schools who do not have a current licence shall be entitled to sign up for a trial in order to take part and shall be considered equal participants.
For the purposes of this Contest Terms, Participating Schools and Participating Students may collectively be referred to as “Participants”.
3. Contest Terms Acceptance
The Participants may access the Contest page either through FrogPlay Platform or www.frogplaychampionships.com.
Subject to a Participating Student who is a minor, each Participant confirms having read and understood, and agrees to be bound by, these Contest Terms through the Participant’s participation in the Contest. In the case of a Participant who is a minor, it is the responsibility of the parents or legal guardian to such Participant to continuously supervise such minor’s participation in the Contest.
4. Contest Period
4.1 This Contest shall commence on 8th April, 2018, 12am (“Commencement Date”). The Contest shall run for a period as more particularly stated herein:
4.1.1 Contest period for Participating Schools is divided into three (3) phases as follows:
(a) Contest 1st phase commencing on the Commencement Date through 31st May 2018, 11.59pm] (“Contest 1st Phase”);
(b) Contest 2nd phase commencing on 4th June 2018, 12am through 29th June, 11.59pm (“Contest 2nd Phase”); and
(c) Contest 3rd phase commencing on 2nd July 2018, 12am through 13th July 2018, 11.59pm (“Contest 3rd Phase”).
4.1.2 Contest period for Participating Students shall commence on the Commencement Date through 31st May, 2018, 11.59pm.
5. Contest Entry Procedure
Participants shall be automatically registered to the Contest. Participants may opt out of the Contest by completing the relevant fields in the opt-out form available on www.frogplaychampionships.com/opt-out within the contest page. 6. Contest Mechanism
6.1 The Contest Mechanism is as follows:-
6.1.1 Participating Schools:
Contest 1st Phase
During Contest 1st Phase, each Participating School is required to log in to Frog VLE and use the FrogPlay Platform. At the end of Contest 1st Phase, three (3) primary and secondary schools respectively with the highest score as reflected on the leaderboard will be named as national champions (“National Champions-School Category”).
In the event of a tie in score between the Participating Schools at the end of the Contest 1st Phase, such Participating Schools are required to respond to the tie-breaker question posed by FrogAsia. Participating Schools with the most creative response as determined by FrogAsia at its sole and absolute discretion, will shall be declared as the National Champions-School Category.
Simultaneous to the selection of the National Champions – School Category, ten (10) Participating Schools, combination of both primary and secondary schools, with the highest scores as reflected on the leaderboard, will be shortlisted to participate in the Contest 2nd Phase (“International Representatives-School Category ”).
The Participating Schools will receive scores on their use of the FrogPlay Platform. The score granted to the Participating Schools is determined by an algorithm within the FrogPlay Platform based on the following broad criteria:
Time spent: The total time spent by each students of the respective Participating Schools in answering the quizzes;
Unique quizzes: Number of diﬀerent quizzes answered by students of the respective Participating Schools;
Quizzes created: Number of quizzes created by teachers from the respective Participating Schools;
Quizzes shared: Number of quizzes shared on Community Quizzes by teachers from the respective Participating Schools;
Teacher logins: Number of teachers from the respective Participating Schools having logged in to the FrogPlay Platform; and
Student logins: Percentage ratio between the number of students having logged in to the FrogPlay Platform against the total number of students in the respective Participating Schools.
In the event of a tie in scores between the Participating Schools at the end of the Contest 1st Phase, such Participants are required to respond to the tie-breaker question posed by FrogAsia. The Participant with the most creative response as determined by FrogAsia at its sole and absolute discretion, will be declared as the International Representatives-School Category.
Contest 2nd Phase
The International Representatives-School Category are required to provide critical analysis on their learning experience, with examples, on their use of FrogPlay Platform during Contest 1st Phase. The critical analysis shall be prepared by way of power point slides (or equivalent), and shall include the contents listed below:-
The impact of FrogPlay Platform on students’ performance, including any changes of behaviour or habit from an academic perspective;
The roles and responsibilities undertaken by the headmaster and teachers to continuously encourage students and creative methods adopted in ensuring a school-wide use of FrogPlay Platform; and
The impact of FrogPlay Platform within the scope of teaching and learning.
(paragraphs (a)-(c) hereinbefore shall be collectively referred to as the “Power Point Slides”)
Scores to the respective International Representative-School Category is determined based on the qualitative and quantitative aspects incorporated into the Power Point Slides, details of which are as more particularly stated below:
Time spent by students in answering the quizzes: The total amount of time spent by students answering the quizzes.
Unique quizzes: Number of diﬀerent quizzes answered by students in the Participating School.
Quizzes created: Number of quizzes created by teachers from the Participating School.
Quizzes shared: Number of quizzes shared to the Community Quizzes by teachers from the respective Participating School.
Teacher logins: Individual logins by teachers of the Participating School.
Student logins: Percentage ratio between the number of students having who have logged in to the FrogPlay Platform against the total number of students in the respective Participating School.
Creativity or innovation: Uses new or fresh ideas, new ways of thinking or new applications to achieve the goal or overcome challenges.
Collaboration: Demonstrates the ability to allow collaboration among teachers, parents and students for sharing of ideas and work together. Building the community through different initiatives.
Difficulty: The level of difficulty to implement the idea, and the challenges faced by such respective Participating School which results on their effort being more commendable.
Impact: Impact on engagement, participation, interest, mindset and usage pattern amongst students, teachers and parents.
Sustainability: Generates long-term benefits or outcomes that will serve as a foundation for continuous enhancement in teaching and learning.
Five (5) finalist from the pool of International Representatives-School Category with the most critical analysis will be selected to participate in the Contest 3rd Phase (“Finalists”).
Contest 3rd Phase
The Finalists are required to attend interview and question and answer session on the impact of FrogPlay Platform within the scope of their teaching and learning experience before a panel of judges appointed by Frog and FrogAsia on a pre-arranged date/(s) as decided by the judges (which shall be between 2nd July, 2018 until 13th July, 2018), and scores will be granted by the judges based on critical analysis and response provided by each of the Finalist.
The scores obtained by the Finalist will be uploaded on the leaderboard.
6.1.2 Participating Students
Each Participating Student is required to log in to the FrogPlay Platform.
The Participating Students will receive scores on their use of the FrogPlay Platform. The scores granted to the Participating Students is determined by the algorithm within the FrogPlay Platform based on the following broad criteria:
Time spent in attempting quizzes from academic year/(s) which are lower than the Participating Students current academic year;
Time spent in attempting quizzes of the same academic year as the Participating Students;
Time spent in attempting quizzes from the academic year/(s) which are higher than the Participating Students current academic year; and
Frequency of daily usage of the FrogPlay platform.
The scores achieved by the respective Participating Students will be reflected on the leaderboard accordingly. The scores on leaderboard shall be on delayed time basis. However, in order to make the Contest more interesting and challenging, Frog/FrogAsia will not display the leaderboard during the final week of the Contest, which is from 25th May, 2018, 12 am through 31st May, 2018, and 11.59pm.
In the event any of the Participating Student is transferred or shifts to a new school (“New School”), any scores obtained by such Participating Student through his/her participation in the Contest prior to the official joining date at the New School shall be automatically forfeited. Notwithstanding hereinbefore, the Participating School shall be entitled to retain the collective scores obtained by it through the participation of such Participant Students up to the date his/her official joining date at the New School. Further, such Participating Student may participate in the Contest as a participant of the New School on condition that the New School is equipped with 4G connectivity and have access to FrogPlay Platform.
In the event of a tie in scores between the Participating Students at the end of the Contest Period, such Student Participants shall be required to answer a tie-breaker question posed by FrogAsia. The Student Participant with the most creative response shall be declared as the champion.
7. Winners Selection Process
7.1 Participating School Category
7.1.1 National Champions-School Category
At the end of the Contest 1st Phase, three (3) Participating Schools with the highest score reflected on the leaderboard will be declared as the National Champions – School Category.
7.1.2 International Champions-School Category
At the end of the Contest 3rd Phase, three (3) schools from a combination of the Representative Countries with the highest score will be declared as the International Champions –School Category.
7.2 Participating Student Category
7.2.1 National Champions-Students Category
Three (3) primary and secondary schools students respectively with the highest scores reflected on the leaderboard will be declared as winners at the national level (“National Winners- Students Category”).
7.2.2 – International Champions-Students Category
Simultaneously, at the international level, three (3) primary and secondary schools students respectively, from a combination of all the Participating Countries, with the highest scores reflected on the leaderboard will be named as International Champions-Students Category.
8. Contest Prizes
8.1 The champions, in order of rank from the most to the least critical shall be categorised as:-
8.1.1 Grand Prize champion;
8.1.21st Runner Up; and
8.1.3 2nd Runner Up
and shall be entitled to the Contest Prizes.
8.2 The champions will be entitled to the following prizes:-
8.2.1 National Champions –School Category
These National Champions-School Category shall each receive the following prize:
Grand Prize Winner: iPad Pro (10.5 inch basic)
1st Runner Up: iPad Standard
2nd RUnner Up: Chromebook
Trophy (for Grand Prize Winner, 1st Runner Up and 2nd Runner Up)
Certificates (for Grand Prize Winner, 1st Runner Up and 2nd Runner Up)
8.2.2 International Champions-School Category
In the event any Finalist is declared as the International Champions-School Category, such International Champion- School Category will receive the following prize:
Grand Prize Winner: USD 3,000
1st Runner Up: USD 2,000
2nd RUnner Up: USD 1,000
Trophy (for Grand Prize Winner, 1st Runner Up and 2nd Runner Up)
Plaque (for Grand Prize Winner, 1st Runner Up and 2nd Runner Up)
Certificates (for Grand Prize Winner, 1st Runner Up and 2nd Runner Up)
8.2.3 National Champions –Student Category
These National Champions-Student Category shall each receive the following prize:
- £50 Voucher from only one of the following stores: Google Play, Amazon or iTunes.
- Exclusive Frog Merchandise
8.2.4 International Champions- Students Category
In the event any of the National Champions- Students Category is declared as the International Champions-Students Category, such International Champion Student Category will receive the following prize:
9. Announcement of International Representatives, Finalists and Champions in Student and School Category
9.1 Student Category
For both National Champions –Student Category and International Champions- Student Category, announcement will be between 4th June, 2018 to 7th June, 2018.
9.2 School Category
For National Champions - School Category, announcement will be between 4th June, 2018 to 7th June, 2018.
For International Champions-School Category, announcement will be on 23rd July 2018.
9.3 Announcement of International Representatives, Finalists and Champions will be done through the email@example.com and Frog/FrogAsia’s Facebook page and/or such other mode or manner as decided by Frog/FrogAsia in its sole and absolute discretion.
The Contest Prizes are given and accepted entirely at the risk of the champions. Any and all prize-related expenses, including tax liabilities (if any) in relation to this Contest, prize and/or use or enjoyment of the same, shall be the sole responsibility of the champions. Frog/FrogAsia shall not be held liable for (i) any delay in performing or partial/total failure to perform any of its obligations to the champions under this Contest if such delay or failure is caused by circumstances beyond the reasonable control of Frog/FrogAsia, its affiliates, authorized dealers/distributors, agents or suppliers, including without limitation delays, changes, disruptions, cancellations, diversions or substitutions howsoever caused including without limitation as a result of war, terrorist action or threatened terrorist action, strikes, hostilities, civil commotions, accidents, fire, flood or natural catastrophes or (ii) from any loss, damage to property, injury, or death resulting from or related to Participating Schools’ participation or inability to participate in this Contest, or the use, misuse or inability to use the Content Prizes or any portion thereof.
11. Unconditional Agreement
Acceptance of the Contest Prizes constitutes the champions unconditional agreement and permission to Frog/FrogAsia and its agencies to use the champions’ names, video footages, voices, photographs and/or likeness for purposes of advertising, editorial, promotional, marketing, trade and/or other purposes without further compensation and notice, unless prohibited by law. Frog/FrogAsia reserves the right to such forms of publicity and publication.
This Contest shall in all respects be governed by the laws of Malaysia and United Kingdom by entering this Contest, the Participant agrees to submit to the jurisdiction of the courts of Malaysia and United Kingdom.
Frog/FrogAsia reserves the right to add, delete, vary or amend the terms and conditions herein or change or modify any aspect of this Contest, in whole or in part at any time and from time to time and at its sole discretion without notice and without liability to the Participating Schools or any other party. Without prejudice to the aforesaid, Frog/FrogAsia reserves the right to cancel, terminate or suspend this Contest at any time before or during the Contest Period with due notice but without any liability or compensation whatsoever. In the event of such cancellation, termination or suspension of this Contest, Frog/FrogAsia may at its sole and absolute discretion choose not to award the prizes in respect of this Contest or choose not to select any champions.
14. Disruption of Contest
Without prejudice to Clause 13 above, if for any reason this Contest is not capable of running as planned or is disrupted for reasons due to and including without limitation network failure, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of Frog/FrogAsia or any party responsible for the running of any aspect of this Contest which corrupts or affects the administration or proper conduct of this Contest, Frog/FrogAsia reserves all rights in Clause 13 above and further reserves the right at its sole and absolute discretion to disqualify any individual or party who tampers or cheat with the processes of this Contest and/or its mechanics and Frog/FrogAsia may take any action (including legal action) against such individual or party. Frog/FrogAsia shall not accept any responsibility for entries not received for whatever reason. Frog/FrogAsia shall not be responsible for technical errors in telecommunications networks, internet access or otherwise preventing entry to this Contest.
15. Disclosure Rights
By entering this Contest, the Participating Schools hereby grant to Frog/FrogAsia express permission as well as a non-exclusive, royalty-free, worldwide license to publish, print, reproduce, disseminate or share their respective entry, likeness and identity (excluding any sensitive personal information as defined by the Personal Data Protection Act 2010) for editorial, advertising, promotional, marketing or other purposes, without further compensation, for an unlimited period of time, in any of Frog/FrogAsia's publications, in any form or any media, whether for public consumption or otherwise, unless prohibited by law.
16. Disqualification and/or Rejection of Entries
Frog/FrogAsia reserves the right to disqualify any or all the Winners at its sole and absolute discretion on grounds of non-compliance with any of the Contest Terms. For the avoidance of doubt, the foregoing is not meant to limit or curtail the rights of Frog/FrogAsia, who may also reject an entry without having to assign any reasons whatsoever. The Participating Schools accept that a decision to disqualify and/or reject such International Representatives, Finalists or champions shall be final and conclusive without any right to appeal. In the event of disqualification after the Contest Prizes, , Frog/FrogAsia reserves the right to demand for the return of the Contest Prize or payment of its value from such ineligible or disqualified Winners.
17. Judging Criteria and Judging Process
FrogAsia reserves the sole and absolute discretion to determine the Participants and champions of this Contest. The judges' decision shall be final and conclusive and no appeals or disputes will be entertained. Subject to FrogAsia's rights to replace any of the champions as provided herein, results once announced shall be deemed as final and binding.
18. General Indemnification
Participants shall indemnify FrogAsia against all and any demands, claims, costs, expenses, damages, liability or injury (whether physical in nature or against the reputation of any party) incurred by FrogAsia, arising out of or relating to the Participants’ participation in this Contest and/or Participants’ acceptance, use or misuse of prizes, including but not limited to any of the Participating Schools’ acts, omissions, statements, publications whatsoever as may be in breach of any law or legal rights, as the case may be.
19. Third Party's Rights and Indemnification
By participating in this Contest, the Participants warrant that all personal details, answers, responses and/or entries submitted in this Contest are true and accurate. Participants agree to indemnify and keep indemnified FrogAsia against all claims, losses, damages and/or expenses whatsoever arising from any infringement or violation of any third party's rights in relation to the submission of any entry in this Contest.
20. Survivability of Terms
Any delay, waiver, non-enforcement, modification, amendment, withdrawal or substitution of any term or condition contained herein shall not affect the operation of the other terms or conditions so affected by such a waiver, non-enforcement, modification, amendment, withdrawal or substitution and which shall remain in full force and effect.
21. Personal Data
By participating in the Contest, each Participant agrees and consents to the processing of Personal Data provided to FrogAsia and/or its service providers shall be used for the purpose of the Contest and as set forth in this Contest Terms. For the avoidance of doubt, the word “Personal Data” and “processing” as used in this Clause 21 shall have the same meaning ascribed to in the Malaysian Personal Data Protection Act 2010.
Failure to comply with these Contest Terms shall result in disqualification of the relevant Participants.
